As we age, there are both health & financial choices to be made
We take the time to make it easy for you
An Enduring Power of Attorney is a legal document that allows you to appoint one or more people to make decisions for you and about you, your financial affairs and your personal affairs when you begin to lose or have lost your mental capacity/cognitive ability.
An Enduring Power of Attorney is only effective when your Attorney registers it and only after a Doctor has certified that you have lost your mental capacity and your cognitive ability.
It is something that many of us consider as we age and it’s something that we can help you with in an empathetic and professional way.
Anytime you're considering putting a legal document in place, it's best to understand the principles behind each piece of paper you sign.
In this case, if you are thinking of setting up an enduring power of attorney for your future, here are a few things that you need to give some thought to.
Types of Enduring Powers of Attorney
One that deals with all of your assets, property and possessions and all personal care decisions.
One that deals with some of your assets, property or possessions and personal care decisions.
One that deals with personal care decisions only.
Personal Care Decisions Include
where you should live,
with whom you should live,
who you should see and not see
what training and rehabilitation you should get
your diet
your dress.
allowing the Attorney to inspect your personal papers
not sure when it will allow the Attorney decide on
what housing or social services or other benefits might be best for you
Remember, an Enduring Power of Attorney is only effective should you become or are becoming mentally incapable of looking after your affairs and must be confirmed after examination by a doctor. The doctor will issue his or her certificate to that effect.
It is only then, that the Attorney or Attorneys can proceed with the registration of the Enduring Power of Attorney. Up until the registration of the Enduring Power of Attorney, you can change your Power of Attorney or you can revoke or cancel it.
An Enduring Power of Attorney may not be appropriate if your assets are substantial, and there is no person with appropriate skills to manage them.
An Enduring Power of Attorney may not be appropriate if there have been persistent family disagreements.
