Most of us are able to make big and small decisions every day, but there may come a time when that is not the case, and hopefully, by then when the Assisted Decision Making (Capacity) Act 2015 becomes law, it will help us maximise our ability to make decisions with legally recognised supports.

Can I Ask A Favour?

The Assisted Decision Making (Capacity) Act 2015 has been passed into law, but the Regulations necessary to implement and introduce it remain un-formulated. Canvass your local politicians to pressurise the Minister for Justice to formulate and introduce the necessary Regulations and Statutory Instrument/s to give full effect the all of the provisions of The Assisted Decision Making (Capacity) Act 2015.

Let me tell you a little more about it.

3 New Levels of Supports

  1. Decision Making Assistant
    You choose your Decision Making Assistant and their job will be to obtain and explain information to you, to help you make a decision, and to express that decision on your behalf. Decision Making Assistants do not assist you with decision making, just in formulating your decision. You can appoint a number of DMAs, to assist you with different types of decisions e.g. you will be able to appoint a trusted family friend to assist with family decisions and to advise you with healthcare decisions

  2. Co-Decision Maker
    You choose your Co-Decision Maker to provide support and information and to make the decision jointly with you. You can appoint a number of co-decision makers, to assist you with different types of decisions e.g. you will be able to appoint an Accountant to assist with financial decisions and a healthcare professional to advise you with healthcare decisions.

  3. Decision Making Representative.
    A Decision-Making Representative is appointed by the Circuit Court to make decisions on your behalf. Ideally, this will be somebody close to you.

 

In addition to appointing a Decision Making Assistant/s and/or appointing a Co-Decision Maker/s, we adults with capacity can provide for a time in the future when we might lose our capacity by putting in place an Enduring Power of Attorney and /or an Advanced Health Care Directive.
