Any time you are entering into a legal contract it’s always best to understand the principles behind each piece of paper you sign.

The law is for everyone so we take the time to show you the options you have to make life easy for you.

5 Questions to consider when renting or leasing farm land:

How long with the lease be?

In legalese, this is called the Term. We will help you consider whether the term be tax efficient for you.

When are guarantees necessary?

If leasing to a farming company, do you want to get a guarantee from the owners of the company? We’ll show you why.

Do you want your tenant to be an “Active Farmer’?

If your tenant is remains an “Active Farmer” for duration of the lease this ensures that you remain qualified for inheritance tax, exemption or relief. We will work with you to consider what happens if the tenant does not continue to be an Active Farmer.

Is the rent to stay the same every year?

Do you want to include a range review clause? What is the best type of rent review clause? Who should review the rent?

Basic payments vs single payments

Check with your farm advisor about your position regarding Basic Payments/Single Farm Payments on the land. Do you want them back after the lease is over?

We help you consider questions such as these in relation to your farm property and we provide remedies in a legally binding lease.

Farm Lease is just one farm related question that we can help you resolve. Make an appointment or fill out our enquiry form and we can discuss any others you face.
